Terms and Conditions

First Five Years

These Terms and Conditions set out the basis on which First Five Years provides consultation and related services. Please read them carefully before booking.


1. Definitions

In these Terms:

Agreement means your booking or order for a Consultation, together with these Terms and any information referenced in them.

Consultation means the applicable First Five Years consultation, programme, session, or package (including in person, online, or digital services) as described at the time of booking.

You means the individual making the booking. Where a Consultation is booked for a child, you confirm you are the child’s parent or legal guardian and authorised to consent on their behalf.

We, us, our means First Five Years and its owner, contractors, successors, and permitted assigns.

Terms means these Terms and Conditions as updated from time to time.

Website means the First Five Years website or any linked booking platform.


2. Bookings and Pricing

Consultations may be booked via our Website, an approved booking platform, or by email, at the prices displayed at the time of booking. All prices are in New Zealand dollars and include GST unless stated otherwise.

Each booking forms a separate binding agreement between you and us, subject to these Terms.

We reserve the right to update prices or service descriptions at any time. Changes will not affect confirmed bookings.


3. Payments

Payment timing Full payment is required at the time of booking or on receipt of our invoice, unless otherwise agreed in writing.

Credit and debit cards Where you pay by card, you authorise the payment and agree to indemnify us for any loss arising from failed payments, reversals, or chargebacks, except where the issue is caused by our error or required by law.

We may suspend or cancel a Consultation if payment is not received by the due date.


4. Cancellations, Rescheduling, and Refunds

Cancellations by you

  • Single session or short consultations must be cancelled at least 48 hours before the scheduled time to be eligible for a refund.

If you need to cancel outside these timeframes, please contact us as soon as possible. We may, at our discretion, offer a partial refund or credit, but are not obliged to do so except where required by law.

Rescheduling by you

  • Single session consultations may be rescheduled with at least 72 hours’ notice using your booking confirmation or by contacting us.
  • Requests to reschedule within 72 hours will be considered on a case by case basis and may incur a fee.

Cancellations or changes by us If we are unable to deliver a scheduled Consultation due to illness, emergency, or other circumstances beyond our control, we will notify you as soon as practicable and offer to reschedule or provide a refund.


5. Digital Programmes and Resources

Where we offer digital programmes, online resources, or downloadable materials:

  • Access is provided immediately upon purchase.
  • All sales are final and non refundable, except where required by law.
  • You are responsible for maintaining the confidentiality of any login details and for the security of your devices.

If the programme includes a community or interactive platform, you are responsible for the information you choose to share. You may request removal of your content by contacting us, subject to platform limitations.


6. Your Responsibilities and Informed Consent

You confirm that all information you provide to us, including medical, developmental, and background information, is accurate and complete to the best of your knowledge.

Where an intake or questionnaire is required, you agree to complete and submit it within the timeframe specified prior to your Consultation. Failure to do so may limit our ability to provide the service and will not entitle you to a refund.

You acknowledge that our services are educational and supportive in nature and rely on your active participation.


7. Disclaimers and Professional Boundaries

No medical advice Our services do not constitute medical, psychological, or mental health advice. We do not diagnose conditions or prescribe treatment. You should seek advice from a qualified healthcare professional for any medical concerns.

No guaranteed outcomes Every family and child is different. While we aim to provide high quality, evidence informed support, we do not guarantee specific results or outcomes.


8. Consumer Law

Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Those rights apply in addition to these Terms.


9. Limitation of Liability

To the fullest extent permitted by law, our liability for any loss or damage arising from or in connection with our services is limited to the amount you paid for the relevant Consultation.

We are not liable for indirect or consequential loss, including loss of income, stress, or disruption to family routines, except where such liability cannot be excluded by law.


10. Confidentiality and Intellectual Property

We will treat your personal information as confidential and handle it in accordance with our Privacy Policy and applicable law.

All materials we provide, including written resources, recordings, and programmes, remain our intellectual property. They are provided for your personal use only and must not be shared, copied, or reproduced without our prior written consent.


11. Privacy

You consent to us collecting, using, and storing your personal information for the purposes of delivering our services. This may include sharing relevant information with contractors, booking platforms, or other service providers involved in delivering the Consultation.

We will comply with the Privacy Act 2020 and only use your information for legitimate business purposes connected to our services.

12. Electronic Communications

By booking with us, you consent to receiving service related and promotional electronic communications. You may opt out of marketing communications at any time by using the unsubscribe link or contacting us directly.


13. Events Beyond Our Control

We are not responsible for delays or failure to perform our obligations due to events beyond our reasonable control, including natural events, government actions, public health emergencies, or technology failures. In such cases, we may suspend or cancel the affected service without liability.


14. Changes to These Terms

We may update these Terms from time to time. The version in force at the time of your booking will apply to that booking.


15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.


16. Waiver

Any waiver of our rights must be in writing and will apply only to the specific circumstances for which it is given.


17. Governing Law

These Terms are governed by the laws of New Zealand, and the parties submit to the non exclusive jurisdiction of the New Zealand courts.
